1. Introduction and Acceptance of Terms

Welcome to NexaTech. These Terms and Conditions govern your use of the NexaTech website at https://nexatech.co.ke and all services offered through it, including the purchase of electronics and accessories through our online shop, and the booking and management of device repair services through our repair platform.

By accessing or using the NexaTech website, placing an order, or booking a repair, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree with any part of these terms, you must not use our website or services.

NexaTech is operated by iLife Solutions LTD, a company registered in Kenya, with its principal place of business at Kimathi House, Suite 304, Moi Avenue, Nairobi, Kenya.

These Terms and Conditions should be read alongside our Privacy Policy and Returns and Refunds Policy, both of which form part of the agreement between you and NexaTech.

2. Definitions

Throughout these Terms and Conditions, the following definitions apply:

  • “NexaTech”, “we”, “us”, and “our” refer to iLife Solutions LTD, trading as NexaTech.
  • “You” and “your” refer to the individual or entity accessing the website or using our services.
  • “Website” refers to https://nexatech.co.ke and all pages, subdomains, and applications associated with it.
  • “Products” refers to all physical goods listed for sale on the NexaTech online shop.
  • “Repair Services” refers to all device diagnostic, repair, and maintenance services offered by NexaTech.
  • “Order” refers to a purchase of one or more Products made through the NexaTech shop.
  • “Booking” refers to a repair service request made through the NexaTech repair platform.
  • “Account” refers to a registered user account on the NexaTech website.
  • “Content” refers to all text, images, graphics, logos, data, software, and other material published on the website.

3. Eligibility

To use the NexaTech website and services, you must:

  • Be at least 18 years of age, or be using the website under the supervision of a parent or legal guardian who agrees to these terms on your behalf
  • Have the legal capacity to enter into a binding contract under the laws of Kenya
  • Not be prohibited from using our services under any applicable law or regulation

By using our website, you represent and warrant that you meet all of the above eligibility criteria. NexaTech reserves the right to refuse service, cancel orders, or close accounts at its discretion if it believes these criteria are not met.

4. User Accounts

4.1 Registration

Some features of the NexaTech website, including order tracking and repair booking management, require you to create a registered account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for keeping your account information up to date.

4.2 Account security

You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. You must notify us immediately at support@nexatech.co.ke if you suspect any unauthorised access to or use of your account.

NexaTech will not be liable for any loss or damage arising from your failure to protect your login credentials.

4.3 Account termination

NexaTech reserves the right to suspend or permanently terminate your account at any time, with or without notice, if we believe you have violated these Terms and Conditions, engaged in fraudulent activity, or used our platform in a manner that is harmful to other users or to NexaTech.

You may close your account at any time by contacting us at support@nexatech.co.ke. Closing your account does not affect any outstanding obligations you have to NexaTech, including unpaid balances or pending orders.

5. Online Shop — Purchasing Products

5.1 Product listings and availability

All products listed on the NexaTech shop are subject to availability. We make every effort to ensure that product descriptions, images, specifications, and prices are accurate and up to date. However, NexaTech does not warrant that product descriptions or other content on the website are completely error-free. In the event of a material error, we will notify you before processing your order and give you the option to proceed or cancel.

Product images are for illustrative purposes only. Actual product colour, size, or appearance may vary slightly from what is shown on screen due to differences in display settings.

5.2 Placing an order

When you place an order on the NexaTech shop, you are making an offer to purchase the selected products at the stated price. Your order constitutes a binding offer once you click “Confirm Order” or equivalent at checkout.

NexaTech reserves the right to accept or decline any order at its discretion. An order is confirmed only when you receive a formal order confirmation by email or SMS from NexaTech. This confirmation constitutes acceptance of your offer and forms a binding contract between you and NexaTech.

5.3 Pricing

All prices displayed on the NexaTech website are in Kenyan Shillings (KES) and are inclusive of VAT unless otherwise stated. NexaTech reserves the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you complete your purchase.

In the event of a pricing error on our website, NexaTech is not obliged to honour the incorrect price. If such an error is discovered after your order has been placed, we will contact you to advise you of the correct price and give you the option to proceed at the correct price or receive a full refund.

5.4 Payment

Payment for orders must be made in full at the time of purchase. NexaTech accepts the following payment methods:

  • M-Pesa
  • Credit and debit cards (Visa, Mastercard)
  • Bank transfer

All payment transactions are processed securely. NexaTech does not store your full card details or M-Pesa PIN. By providing your payment details, you confirm that you are authorised to use the payment method and that the information you provide is accurate.

NexaTech reserves the right to cancel any order where payment is not successfully received or where a transaction is flagged as potentially fraudulent.

5.5 Bulk and corporate orders

For bulk purchases or corporate procurement enquiries, please contact us at shop@nexatech.co.ke before placing your order. Separate terms may apply to bulk or corporate arrangements, which will be set out in a written agreement between you and NexaTech.

6. Delivery

6.1 Delivery areas

NexaTech offers delivery within Nairobi and to other locations across Kenya. Delivery fees and estimated delivery timeframes are displayed at checkout and vary depending on your location.

6.2 Delivery timeframes

We aim to dispatch all confirmed orders promptly. Estimated delivery timeframes are as follows:

  • Within Nairobi: Same-day delivery is available for orders placed before the daily cut-off time, subject to stock availability
  • Other locations in Kenya: Standard delivery typically takes 1 to 3 business days

These timeframes are estimates only and are not guaranteed. NexaTech is not liable for delays caused by factors outside our control, including adverse weather, courier disruptions, or public holidays.

6.3 Risk and ownership

Ownership of and risk in the products passes to you upon successful delivery and confirmation of receipt. If a delivery is unsuccessful due to you providing an incorrect address or being unavailable to receive the order, NexaTech may charge a redelivery fee.

6.4 In-store collection

You may collect your order in person from our service centre at Kimathi House, Suite 304, Moi Avenue, Nairobi. Please contact us in advance to confirm your collection time. A valid form of identification and your order confirmation will be required at collection.

7. Repair Services

7.1 Booking a repair

Repair services can be booked through the NexaTech repair platform at https://nexatech.co.ke/app/. By submitting a repair booking, you confirm that you are the legal owner of the device or have the authority of the legal owner to authorise its repair.

7.2 Free diagnostics

Every device submitted for repair receives a free diagnostic assessment. Following the assessment, you will receive a written quote detailing the fault identified and the cost of repair. No repair work will commence without your explicit approval of the quote.

7.3 Approval and commencement of repair

By approving a repair quote — whether verbally, via SMS, or through the repair tracking platform — you authorise NexaTech to carry out the agreed work and agree to pay the quoted amount upon completion. If additional faults are discovered during the repair that were not identified in the initial diagnostic, we will contact you with an updated quote before proceeding.

7.4 Repair warranty

All completed repairs are covered by a 90-day service warranty. This warranty covers defects in parts used and workmanship related to the specific repair carried out. It does not cover new or unrelated faults, accidental damage occurring after collection, water damage, or faults resulting from unauthorised modifications by third parties after the repair.

7.5 Uncollected devices

If a repaired device is not collected within 30 days of notification that it is ready, NexaTech reserves the right to charge a storage fee. If a device remains uncollected for more than 90 days after notification, NexaTech may, at its discretion, treat the device as abandoned. We will make reasonable efforts to contact you before taking any such action.

7.6 Data and personal information on devices

NexaTech takes reasonable precautions to protect the personal data stored on devices submitted for repair. However, by submitting a device for repair, you acknowledge and accept that:

  • NexaTech cannot guarantee the preservation of data stored on a device, particularly in cases involving software repair, water damage, or component replacement
  • You are solely responsible for backing up any data on your device before submitting it for repair
  • NexaTech will not be liable for any loss of data occurring during the repair process

7.7 Devices beyond repair

If a device is assessed and found to be beyond economical repair, you will be notified at no charge. The device will be returned to you in the condition it was received. NexaTech will not be responsible for any deterioration of a device’s condition that existed prior to submission.

8. Returns and Refunds

Returns and refunds are governed by our separate Returns and Refunds Policy, which is incorporated into these Terms and Conditions by reference and is available in full at nexatech.co.ke/returns-policy. By placing an order, you confirm that you have read and understood that policy.

9. Intellectual Property

9.1 Ownership of content

All content on the NexaTech website — including but not limited to text, graphics, logos, product images, icons, software, and the overall design and layout of the website — is the property of iLife Solutions LTD or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws.

9.2 Permitted use

You may access and use the NexaTech website for personal, non-commercial purposes only. You may not, without our prior written permission:

  • Copy, reproduce, distribute, or republish any content from the website
  • Modify, adapt, or create derivative works based on our content
  • Use our trademarks, logos, or brand assets in any way that implies affiliation or endorsement by NexaTech
  • Scrape, crawl, or systematically extract data from our website using automated tools

9.3 User-submitted content

If you submit content to our website — such as product reviews, comments, or repair descriptions — you grant NexaTech a non-exclusive, royalty-free, perpetual licence to use, display, reproduce, and moderate that content in connection with the operation of our platform. You warrant that any content you submit does not infringe the intellectual property rights of any third party.

10. Prohibited Conduct

When using the NexaTech website and services, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable law or regulation
  • Submit false, misleading, or fraudulent information in connection with any order, booking, or account
  • Attempt to gain unauthorised access to any part of our website, systems, or user accounts
  • Upload or transmit any viruses, malware, or other harmful code
  • Engage in any conduct that disrupts, damages, or impairs the functionality of the website or our services
  • Use our platform to harass, threaten, or harm other users or NexaTech staff
  • Attempt to circumvent any security or access control measures on our website
  • Misrepresent your identity or impersonate any person or entity

NexaTech reserves the right to take appropriate legal action and to suspend or terminate your account if you engage in any of the above conduct.

11. Third-Party Links and Services

The NexaTech website may contain links to third-party websites, platforms, or services for your convenience. These links do not constitute an endorsement of those websites or their content. NexaTech has no control over the content, privacy practices, or availability of third-party websites and accepts no responsibility or liability for them.

Your use of any third-party website is at your own risk and subject to that website’s own terms and conditions and privacy policy.

12. Disclaimer of Warranties

The NexaTech website and all products and services offered through it are provided on an “as is” and “as available” basis. To the fullest extent permitted by Kenyan law, NexaTech makes no representations or warranties of any kind, express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the website will be uninterrupted, error-free, or free of viruses or other harmful components
  • Warranties regarding the accuracy, completeness, or reliability of any content on the website

Nothing in these Terms and Conditions excludes or limits any warranty that cannot be excluded under applicable Kenyan consumer protection law.

13. Limitation of Liability

To the fullest extent permitted by law, NexaTech and iLife Solutions LTD shall not be liable to you for any:

  • Indirect, incidental, or consequential loss, including loss of profit, loss of revenue, loss of data, or loss of business opportunity
  • Loss or damage to a device submitted for repair that is attributable to pre-existing conditions, customer-caused damage, or circumstances outside our control
  • Loss of data stored on a device submitted for repair, regardless of the cause
  • Delays in delivery or repair caused by factors outside our reasonable control

Our total liability to you in connection with any order or repair booking shall not exceed the amount paid by you for that specific order or repair.

Nothing in these Terms and Conditions limits NexaTech’s liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

14. Force Majeure

NexaTech shall not be held liable for any failure or delay in performing its obligations under these Terms and Conditions where such failure or delay is caused by circumstances beyond our reasonable control. These include, but are not limited to, acts of God, natural disasters, fire, flooding, strikes or industrial action, government restrictions, power failures, internet outages, civil unrest, or pandemic-related disruptions.

In such circumstances, NexaTech will notify you as soon as reasonably practicable and will make every reasonable effort to resume normal operations promptly.

15. Indemnification

You agree to indemnify, defend, and hold harmless NexaTech, iLife Solutions LTD, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses — including reasonable legal fees — arising out of or in connection with:

  • Your use of the NexaTech website or services
  • Your breach of these Terms and Conditions
  • Any content you submit to the website
  • Your violation of any applicable law or the rights of any third party

16. Privacy

Your use of the NexaTech website is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data. By using our website and services, you confirm that you have read and accepted our Privacy Policy.

17. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these terms, or your use of the NexaTech website and services, shall be subject to the exclusive jurisdiction of the courts of Kenya.

Your continued use of the NexaTech website and services after any changes have been published constitutes your acceptance of the revised terms. If you do not agree with the updated terms, you must stop using our website and services.

We recommend reviewing this page periodically to stay informed of any changes.

19. Severability

If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision shall be severed from these terms. The remaining provisions shall continue in full force and effect.
